Assumed Names

An Assumed name for a business or For-Profit Trade is an important branding strategy for a person or entity. A Fictitious Business Name (FBN) statement, a Doing Business As (DBA) or an Assumed Name is used by an Individual or Entity when the actual name does not resemble with the business name or Individual.

The Assumed Name is public record and reveals the identity of the actual person that is conducting business under an assumed name. The process of filing an Assumed name varies from State and to State and County to County.

Assumed names are filed either in the County Clerk's office that has Jurisdiction over the Business or with the Office of The Secretary of State. Effective September 1st, 2019, A Texas Corporation, Limited Partnership, Limited Liability Company or a foreign filing entity is no longer required to file in the office of each county clerk where business is to be conducted. Ref: (86(R) HB3609) However, a sole proprietor is still required to file an assumed name in the county clerk's office where business is conducted and must obtain an Assumed name certificate.

For Corporate Entities, Assumed name must to filed with the Office of The Secretary of State's Office.
